TCN Privacy Policy

We collect the e-mail addresses of those who communicate with us via email, aggregate information on what pages consumers access or visit, and information volunteered by the consumer (such as survey information and/or site registrations). The information we collect is used to improve our Web pages’ content and the quality of our service and is not shared with or sold to other organizations for commercial purposes, except to provide products or services you’ve requested, when we have your permission. Such exceptions apply only to TCN clients and would be shared only with TCN partners handling Data Management or Accessibility options, or TCN clients or potential clients looking for references on services, etc. In such a case, your permission will be obtained before making your information available.

If you are a TCN client wishing to port telephony services off of the TCN platform, we would need to confirm your information with the Telephony service provider(s) you have engaged in taking over the applicable service. Incorrect validation information would not be confirmed.

Additionally, your information may be shared under the following circumstances:

It is necessary to provide information to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to any person’s physical safety, violations of Terms of Service of the specific application, or as otherwise required by law.

TCN, Inc. is subject to the oversight and enforcement authority  United States Federal Trade Commission (FTC).

Information Gathering and Usage

We do not collect personally identifiable information from our visitors other than what is supplied to us voluntarily. When you register voluntarily to be contacted via our Contact Us link or receive a Demo for any TCN, Inc. product, we ask for information such as your name, company name, email address, etc.

TCN, Inc. uses collected information for the following general purposes: products and services provision, billing, identification and authentication, services improvement, contact, and research. TCN, Inc. does not share your personal information with non-agent third parties unless explicitly approved by you. Please see Data Storage & Third Party Transfer section below for TCN’s agents under normal operations. TCN, Inc. processes telecommunications data on behalf of such data owners from the countries they reside in. Such information is confidential and provided only to its owners. If you use the Site without registration, the only information we collect will be non-personal information related to your IP address, web browser, and operating system.

TCN, Inc. recognizes an individual’s right to access their own data. Individuals wishing to review, correct, delete or otherwise amend their personal information may do so by following the steps listed below under Privacy Complaints by European Union Citizens, or Privacy Complaints by Swiss Citizens, respectfully.

Cookies

A cookie is a small amount of data, which often includes an anonymous unique identifier sent to your browser from a website’s computers and stored on your computer’s hard drive. Cookies are required to use the TCN, Inc. services. We use cookies to record current session information but do not require permanent cookies.

Data Storage & Third Party Transfer

TCN, Inc. has partnered with Google Cloud Platform to provide infrastructure services for the TCN Operator platform. Although TCN, Inc. owns the code, databases, and all rights to TCN, Inc. hosted applications, you retain all rights to your data. TCN, Inc. is liable for onward transfers to third parties of EU or Swiss individuals’ personal data received according to the Data Privacy Framework Principles unless we can prove we were not a party giving rise to the damages.. TCN, Inc. only shares data with agent partners in providing contracted services for clients. TCN, Inc. does not share information with non-agent partners and does not expect to do so in the future. If this changes, individuals will be given an option for opting out of the sharing of their information with third parties.

Disclosure

TCN, Inc. may disclose personally identifiable information under special circumstances, such as to comply with subpoenas or when your actions violate the Terms of Service of any of our applications. We may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements. TCN allows individuals to limit the use or disclosure of personal information by emailing us at privacy@tcn.com or through written correspondence to TCN’s corporate offices.

Changes & Acceptance of Terms and Conditions

Using this site, you signify your agreement to the terms and conditions of TCN, Inc. Communications Website Privacy Policy. At our sole discretion, we reserve the right to change, modify, add, or remove portions of this policy at any time. Please check this page periodically for any changes. Your continued use of the TCN, Inc. Communications Website following the posting of any changes to these terms shall mean that you have accepted those changes.

EU-US Data Privacy Framework (EU-US DPF), the UK Extension to the EU-US DPF, and the Swiss-US Data Privacy Framework (Swiss-US DPF)

TCN, Inc. complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. TCN, Inc. has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Although TCN, Inc. does not require any specific piece of personal information beyond a phone number in the normal course of business, our clients will often utilize additional points of reference, including (but not limited to): names, addresses, additional contact information, and basic information regarding accounts or credit, like account numbers or balances. TCN, Inc. does not share nor make this information available to any other clients, groups, or individuals, except as noted in the disclosure statement above.

Our privacy policy above serves as our statement of adherence to the EU-US DPF, the UK Extension to the EU-US DPF and the Swiss-US DPF. We encourage you to use the contact information provided herein to inform us of any complaints or disputes you may have regarding the use of your personal information. We will thoroughly investigate the matter internally and make every effort to attempt to resolve the issue quickly. If your dispute cannot be resolved internally, we agree to dispute resolution with BBB National Programs as our third-party resolution provider.

Privacy Complaints by EU, United Kingdom, and Swiss Citizens

In compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF), TCN, Inc. commits to resolve complaints about our collection or use of your personal information transferred to the U.S. pursuant to the EU-U.S. DPF, the UK extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. Pursuant to the DPF Frameworks, TCN acknowledges the right of EU, UK, and Swiss individuals to have access to their personal data to review, update or correct inaccurate information or request removal of data that has been processed in violation of the DPF Principles.

TCN, Inc. has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbbprograms.org/dpf-complaints for more information and to file a complaint. This service is provided free of charge to you.

If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. See the dataprivacyframework
